This facilty may not be in operating compliance with Chapter(s) 63-761/762, Florida Administrative Code standards. Any noncompliance item should be corrected immediately. Please provide a written response to this office within 30 calendar days upon receipt of this letter and provide documentation to show that the issues addressed in this letter have been resolved. Please include the facility identification number on all correspondence. Your failure to respond may result in further enforcement action.

Please be aware that violations of Chapter(s) 62-761/762, FAC, may subject you to penalties of up to $10,000 per day per violation, in addition to investigative costs. These penalties and costs may be imposed in accordance with Chapters 376 and 403, Florida Statutes.

NOTE

All single walled regulated Underground Storage Tanks Systems must be upgraded with secondary containment by December 31, 2009 in accordance with Rule 62-761.510, F.A.C.

All single walled regulated Aboveground Storage Tank Systems must be upgraded with secondary containment by January 1, 2010 in accordance with 62-762.511, F.A.C.
